New NCMS Account Setup

The process to become NCMS compliant is fairly straightforward. You’ll start by creating an NCMS account for your business.  Your second step is to call Cascade QMS and meet your dedicated consultant!

New NCMS Account Setup includes:

  • Consultation to discover your hiring client and regulatory requirements as needed for NCMS compliance.  Helping your company create a drug and alcohol testing policy that not only meets your hiring client requirements but also adheres to industry and federal standards.  Our initial consultation will uncover background check requirements as well as testing pool obligations.
  • Having a drug and alcohol testing consortium will be a requirement.  If your company isn’t already a part of a consortium, your dedicated Cascade QMS consultant will identify the best possible solution.  We will assist in the new consortium onboarding process if needed.
  • Our consultants will assist your company in adopting any new policies that are created.  This includes employee advisory, identifying employee roles and eligibility, acknowledgment retrieval, and roster creation.
  • Drug and alcohol tests will be deligated as needed by your Cascade QMS consultant to satisfy your initial client requirements and meet the deadline for your NCMS audit.

National Compliance Management Service, Inc. (NCMS) specializes in contractor monitoring for the oil and gas industry. They streamline the contractor qualification process, ensuring compliance with regulations, particularly PHMSA standards. NCMS offers continuous monitoring, auditing, and data management through a dedicated web portal. They facilitate effective communication between contractors and operators to minimize compliance issues and avoid unnecessary downtime. Their services are designed to create partnerships and provide real-time compliance data.

The type of documentation needed for NCMS compliance will vary based on the hiring client you are becoming certified for. 

A safety consultant can help expedite the process, ensure accuracy, and help you create and submit all required documents. An NCMS audit is a safety compliance evaluation conducted by the National Compliance Management Service, Inc. to ensure contractors meet industry and operator-specific requirements, primarily in the oil and gas sector.

A drug consortium is an association of companies, often within the transportation or safety-sensitive industries, that pool their resources to manage drug and alcohol testing programs. These consortia ensure compliance with federal regulations (e.g., DOT requirements in the U.S.) by overseeing random testing, maintaining testing records, and providing training and support. This collaborative approach helps smaller companies comply with regulatory requirements cost-effectively and efficiently.  Among the most popular consortiums are DISA Global Solutions.

When entertaining contracts and jobs in oil and gas or energy industries you’re likely to encounter a company that requires NCMS compliance.  Your hiring client will disclose this requirement in the initial steps of an MSA.  Companies must have an NCMS invite from a hiring client in order to become a member.

In the context of Drug and Alcohol (D&A) testing, TPA stands for Third-Party Administrator. A TPA is an external organization that manages various aspects of drug and alcohol testing programs for companies. This includes tasks like arranging tests, maintaining records, ensuring compliance with regulations, and handling administrative functions related to the testing process. TPAs are especially common in industries regulated by federal laws, such as transportation, where they help businesses adhere to strict testing requirements efficiently.  Among the most popular TPAs are Pipeling Testing Consortium Inc.

In the context of Drug and Alcohol (D&A) testing, statistical data refers to the collection and analysis of data related to drug and alcohol test results. This includes metrics such as:

  • The number of tests conducted.
  • The percentage of positive and negative results.
  • Trends over time in substance use among the tested population.
  • Breakdown of results by different substances.
  • Data on follow-up tests and compliance rates.

The NCMS Random Process involves randomly selecting employees for drug and alcohol testing to ensure compliance with safety and regulatory standards, particularly in the oil and gas industry. This process is managed through a systematic and unbiased method, ensuring that each individual has an equal chance of being selected. The goal is to maintain a drug-free workplace and to comply with federal regulations.

A policy developed specific to each drug policy and client requirements.  The Model Plan has specifics to TPA information.  The Model Plan is driven by your client requirements for your company based on industry and federal standards.  This policy would be created by your Cascade QMS consultant and include your TPA, Designated Employer representative (DER), Medical Review Officer (MRO)

PHMSA stands for the Pipeline and Hazardous Materials Safety Administration. It’s a United States Department of Transportation agency responsible for ensuring the safe transportation of energy and hazardous materials by pipeline and other modes. PHMSA develops and enforces regulations for pipeline safety, including design, construction, operation, and maintenance standards. It also oversees the safe transportation of hazardous materials by all modes of transportation, including pipelines, trucks, trains, ships, and aircraft.

The Drug and Alcohol Clearinghouse is a secure online database maintained by the Federal Motor Carrier Safety Administration (FMCSA), a part of the U.S. Department of Transportation (DOT). It was established to improve road safety by providing access to information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations.

Here’s how it works:

  1. Reporting Violations: Employers, Medical Review Officers (MROs), Substance Abuse Professionals (SAPs), and other authorized parties are required to report drug and alcohol program violations of CDL and CLP holders to the Clearinghouse.

  2. Queries and Registration: Employers must query the Clearinghouse as part of their hiring process to check if prospective drivers have any drug or alcohol violations. They also need to query the database annually for current employees.

  3. Notification: The Clearinghouse alerts employers if new violations are added to a driver’s record.

  4. Driver Consent: Drivers must provide consent for employers to access their Clearinghouse record. They can also review their own record.

The Clearinghouse aims to prevent CDL holders with drug and alcohol violations from moving between jobs and evading the consequences. It enhances safety on the roads by ensuring that only qualified and safe drivers are operating commercial vehicles.

If your company is not compliant and in satisfactory status with policies and documentation in NCMS, your ISNet grade will certainly be impacted for those clients requiring both systems such as Embridge.  

Open audits can often be an issue as well as a prolonged period of non-compliance.
